An Appeal to Remember

The Fourth Circuit reversed and remanded this case today, finding that the district court erred when it granted the defendant a judgment of acquittal.  The Fourth Circuit found that substantial evidence in the record supported the jury verdict that the defendant acted with an intent to defraud investors. 

In this unpublished opinion, the Fourth Circuit affirmed the defendant’s guilty plea to one count of racketeering conspiracy.  In so doing, the court engages in a brief discussion of the Moore factors in addressing the defendant’s argument that he should have been permitted to withdraw his guilty plea.
